Guide · AI on WhatsApp · For the owner choosing an AI provider

Can an AI company learn from your WhatsApp customer chats? What Meta's terms let a provider do with them, for the owner

If the company that would run your WhatsApp also builds AI, Meta's terms for the WhatsApp Business Platform allow it, but they set a firm rule on what happens to your customer chats: they must not be used to train or improve AI models, with one narrow exception. Here is what the terms say, what Meta's processor terms say Meta does with the data, what WhatsApp tells your customers, and what to ask a provider before you sign.

Published 13 October 2026

Which terms these are

The rules below come from the Meta Terms for WhatsApp Business Platform, which Meta last modified on 23 September 2026. They apply when a business signs up for or uses the WhatsApp Business Platform. Meta says that unless you are in the United States or Canada, your contract is with Meta Platforms Ireland Limited, though in some circumstances it may be an affiliate of Meta.

The same terms say that separate terms apply when you use Meta's own optional Business Agents, and that different or additional terms may apply to other AI-related technologies used with the platform. Meta's own agent is covered in our guide to the Business Agent terms in plain language. This guide is about a different case: an outside company that builds AI and also connects your number.

Who Meta counts as an AI Provider

Section 4.7 of the terms defines AI Providers as providers and developers of artificial intelligence or machine learning technologies. Its examples are large language models, generative AI platforms, general-purpose AI assistants, or similar technologies as Meta decides in its sole discretion.

Meta says AI Providers are strictly prohibited from using the platform, directly or indirectly, to offer those technologies when they are the primary (rather than incidental or ancillary) functionality being made available. Meta again decides that in its sole discretion. The terms make an exception for businesses in certain countries, which Meta lists on a separate page; that rule and the country list are in our guide to Meta's AI providers rule.

An AI company can still run your WhatsApp

The same section then says that you may retain an AI Provider as your Solution Provider. In plain words, and this is our reading: a company that builds AI can still be the company that connects your number and runs your WhatsApp for you. Meta's terms use the term Solution Provider without defining it on this page.

The condition comes in the next sentence, and it is aimed at you, the business.

The rule: your chats must not train AI models

When an AI Provider is your Solution Provider, Meta says you may not directly or indirectly allow WhatsApp Business Platform Data to be used to create, develop, train, or improve any machine learning or artificial intelligence systems, models or technologies, including large language models. The ban covers anonymous, aggregate, or derived forms of the data too, so data with names stripped out is still covered.

The one exception
You may use the data to fine-tune an AI model that is for your exclusive use, so long as this does not result in the data being used to create, develop, train, or improve any other AI model.
How long it lasts
Meta says the section survives termination of the terms, so the rule does not end when you stop using the platform.

Our reading: the duty sits with you

The sentence is written to the business, not only to the provider: you may not allow it. If a provider uses your customer chats to improve a model it also sells to other clients, our reading is that this is the kind of use the terms rule out, and it is your account the terms are about.

What counts as your platform data

Section 4.1 defines WhatsApp Business Platform Data as data you obtain from using the WhatsApp Business Platform, and adds two more limits on it:

No profiles of people
Except for the content of your message threads, you must not use it to track, build, or augment profiles on individual WhatsApp users.
No passing it on
You must not share, transfer, sell, license, or distribute it, including anonymous, aggregate, or derived forms, to any third party, except to a Solution Provider in accordance with the terms.

Meta says it may terminate your account and revoke your access if it reasonably determines that you have breached these restrictions. This section also survives termination.

What Meta says it does with the data

Section 1.4 of the terms says that where Meta acts as a processor of personal data for which you are the controller, the Meta Global Processor Terms apply. Those terms were last updated on 20 March 2026. They say:

At your direction
Meta processes the data for and at the direction of the business, for the purposes in the applicable terms, or as the law requires or permits.
Disclosure
Meta does not disclose it except at the business's direction, as the processor terms permit, or as the law requires or permits.
After you leave
If you ask in writing within thirty days after the terms end, Meta returns the data to the extent reasonably practicable. If you do not, Meta deletes its copies under its data retention policies, except where the law requires otherwise or the terms let you allow Meta to keep copies.
Meta's staff
People at Meta who process the data are under a duty of confidentiality.
De-identified data
Meta may de-identify and anonymize the data it receives and process it as the law permits.

The same terms put two duties on the business:

Notice and consent
Give people notice and obtain the consents, or another lawful basis, for sharing their data with Meta and for Meta processing it.
What not to send
Do not share with Meta data you know, or reasonably should know, is from or about children under 13 or under the age of online minority where you are, or that includes health data, financial data or other sensitive categories of data.

What WhatsApp tells your customers

WhatsApp's Privacy Policy tells people that when they message a business, what they share may be visible to several people in that business. It adds that some businesses work with third-party service providers, which may include Meta, and may give them access to send, store, read, manage, or otherwise process their messages. To understand how a business handles their information, WhatsApp tells them to review that business's privacy policy or contact the business directly.

WhatsApp's Help Center adds that a business can choose Meta as its secure cloud storage provider. In that case Meta stores messages for the business, and WhatsApp retains information on who the business receives messages from or sent messages to. WhatsApp says these messages are clearly labeled in the chat, to tell them apart from personal messaging.

Our reading: your privacy policy is where customers are sent

WhatsApp points your customers to your own privacy policy for the details. If an outside company reads or stores your chats for you, that policy is the place a customer is told to look.

Questions to put to any AI provider

Our reading, not legal advice

These questions follow from the terms above. They are not a legal checklist, and a lawyer who knows your country's rules is the right person for the legal side.
Training
Will our customer chats, in any form, be used to train or improve a model that other clients also use?
Fine-tuning
If you fine-tune a model on our chats, is that model for our business alone, and does nothing learned from it go into any other model?
Passing it on
Who else receives our chat data, including in anonymous or summary form?
Our privacy policy
Does our own privacy policy tell customers that we use service providers to handle their messages?
Sensitive details
How do we keep health or financial details, and anything about children, out of what reaches Meta?

Questions

Can a company that builds AI connect and run our WhatsApp?

Yes. Meta's terms say you may retain an AI Provider as your Solution Provider (in our reading, the company that connects and runs your WhatsApp). The condition is that you must not let your platform data be used to create, develop, train or improve AI models.

Does removing names make it acceptable to train on our chats?

No. Meta's terms extend the rule to anonymous, aggregate, or derived forms of the data.

Can a model be fine-tuned on our chats at all?

Yes, if the model is for your exclusive use and the data does not end up creating, developing, training or improving any other AI model.

Does the rule end if we leave the platform?

No. Meta says the section survives termination of the terms.

Who is BitByteCore?

BitByteCore is a verified Meta Tech Provider (since 9 September 2026). It does not set up Meta's AI agent for anyone. This guide explains Meta's own terms.

Want every customer chat in one place your team controls?

We set up a business's WhatsApp number on a system its team runs, so every conversation sits in one inbox the business controls and the whole team can answer from it. A short call is the easiest way to see how that would work for you.
